By accessing or using DNArcade, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our services.

You must be at least 18 years old to use DNArcade. By using our services, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Description of Service

DNArcade provides a service that:

• Accepts DNA data files from major genetic testing providers (23andMe, AncestryDNA, MyHeritage, FamilyTreeDNA)
• Analyzes specific genetic markers (SNPs) using our proprietary algorithm
• Generates an RPG-style character profile with stats, class, and traits
• Allows sharing of character profiles on social media
• Provides entertainment based on real genetic science

3. User Accounts

3.1 Account Creation

To use certain features of DNArcade, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account use
• Be responsible for all activities under your account

3.2 Account Termination

We may suspend or terminate your account if you violate these Terms or engage in fraudulent or illegal activity. You may delete your account at any time through your account settings.

4. DNA Data

4.1 Ownership

You retain all rights to your genetic data. By uploading your DNA file, you grant DNArcade a limited, non-exclusive license to process your data solely for the purpose of generating your character profile.

4.2 Your Representations

By uploading DNA data, you represent and warrant that:

• The DNA data belongs to you or you have authorization to upload it
• You obtained the DNA test legally and ethically
• You are at least 18 years old
• You understand this is an entertainment service, not medical advice

4.3 Prohibited Uses

You may NOT upload:

• DNA data belonging to another person without their explicit consent
• DNA data from minors (persons under 18)
• Data obtained through illegal means
• Falsified or synthetic DNA data intended to deceive

5. Subscriptions and Payments

5.1 Free Tier

DNArcade offers a free tier with limited features. Free accounts can create one character profile with basic stats.

5.2 Paid Subscriptions

Premium features are available through paid subscriptions (Champion and Legend tiers). Subscriptions are billed monthly or annually through PayPal.

5.3 Billing

• Subscriptions automatically renew unless cancelled
• You will be charged at the start of each billing period
• Prices are in USD and may be subject to taxes
• We reserve the right to change prices with 30 days' notice

5.4 Cancellation and Refunds

• You may cancel your subscription at any time
• Access continues until the end of your current billing period
• We offer a 7-day money-back guarantee for new subscriptions
• Refund requests after 7 days are evaluated on a case-by-case basis

6. User Content

6.1 Character Profiles

Your character profile is your content. You may share it publicly or keep it private. By sharing publicly, you grant DNArcade permission to display your character on our platform and promotional materials.

6.2 Display Names

You are responsible for choosing appropriate display names for your characters. Names that are offensive, infringing, or violate our community guidelines may be removed.

7. Intellectual Property

7.1 Our Property

DNArcade and its original content, features, and functionality are owned by DNArcade and protected by international copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use DNArcade for personal, non-commercial purposes.

7.3 Restrictions

You may NOT:

• Copy, modify, or distribute our content without permission
• Reverse engineer our analysis algorithms
• Use our trademarks without authorization
• Scrape or collect data from our platform
• Use our service for competing products

8. Disclaimers

DNArcade is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, DNArcade and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Any damages arising from your use of the service
• Unauthorized access to your data

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless DNArcade, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your use of the service
• Your violation of any third-party rights
• Any content you submit or share

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or a notice on our website. Your continued use of DNArcade after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
